Parking regulations
The following parking regulations apply to the use of the Hochkar Bergbahnen parking lots:
1. General provisions
1.1 The use of parking spaces (hereinafter referred to as “parking lot”) is only permitted after concluding a usage agreement.
1.2 The usage agreement is concluded exclusively between Hochkar & Ötscher Tourismus GmbH (hereinafter referred to as “parking operator”) on the one hand and the user of the parking lot in compliance with these parking regulations valid at the time of parking on the other hand.
1.3 Any use of parking spaces that has not been expressly approved by Hochkar & Ötscher Tourismus GmbH is invalid and therefore prohibited (unauthorized possession).
2. Subject matter of the contract
2.1 By concluding the usage agreement, the user acquires the right to park a roadworthy and officially registered motor vehicle in a free and suitable parking space between 7:00 and 20:00. Excluded from these hours are areas specifically marked by the operator that are reserved for restaurants, overnight guests, multi-day parkers, or special events organized by Hochkar & Ötscher Tourismus GmbH.
2.2 This usage agreement is concluded upon purchasing a parking ticket (online or at the lift ticket office) for the vehicle license plate number specified at the time of purchase. If the user parks a different vehicle than the one indicated during the online purchase, this must be reported immediately to the ticket office or via email to the parking operator.
2.3 By concluding the usage agreement, the user accepts the provisions of these parking regulations.
2.4 The provisions of the Austrian Road Traffic Regulations (StVO) in their current version apply in the parking lot. The maximum speed allowed is walking speed.
2.5 The parking operator does not assume any obligation to monitor or safeguard the vehicle, its accessories, or any objects inside or brought into the parking lot with the vehicle.
2.6 Designated disabled parking spaces may only be used by persons with a valid and clearly visible disabled parking permit in accordance with § 29b StVO.
3. Liability provisions
3.1 The use of the parking lot is at the user’s own risk. The operator is not liable for the conduct of third parties, theft, or break-ins. The operator is only liable for damage to a vehicle if such damage was caused intentionally or through gross negligence by the operator or its employees. This also applies to the relocation of a vehicle carried out at the explicit request of the user.
3.2 The operator is not liable for damage caused directly or indirectly by force majeure to a parked vehicle.
3.3 The user undertakes to secure and lock the parked vehicle properly.
3.4 The instructions of the operator and its employees must be followed in the interest of smooth operation and safety.
3.5 Any damage to parking equipment or other vehicles caused by the user must be reported to the operator immediately before leaving the parking lot, as well as any damage discovered on one’s own vehicle. Such damage must be reported immediately after discovery, documented photographically, and submitted to the operator together with the damage report. Damage reported after leaving the parking lot cannot be recognized. Statutory reporting obligations remain unaffected.
4. Parking fees and operating hours
4.1 Vehicles may only be parked with a valid and properly obtained parking ticket.
4.2 The current tariff and any other fees are displayed online in the webshop and on-site on the information boards.
4.3 Parking is permitted only between 7:00 and 20:00 daily. Continuous parking for longer periods (e.g., several days) and parking between 20:00 and 7:00 is not permitted. Exceptions apply to specifically marked areas reserved for restaurants, overnight guests, and multi-day parkers, as well as special regulations during events organized by Hochkar & Ötscher Tourismus GmbH.
4.4 The parking fee must be paid at the start of the parking period at the latest.
5. Parking the vehicle
5.1 The vehicle must be parked in such a way that third parties are not obstructed, and that specially designated parking spaces such as disabled spaces or reserved spaces (e.g., for electric vehicles) are not used unlawfully. Parking in a manner contrary to traffic regulations is prohibited.
5.2 If a vehicle is parked in violation of these parking regulations — particularly if towing under the StVO would be justified — or if the permitted parking time is exceeded, the operator is entitled to take legal action against the vehicle owner. The costs incurred will be charged to the vehicle owner.
6. Rules of conduct
6.1 Only roadworthy and officially registered vehicles may be parked in the parking lot.
6.2 The following activities are prohibited:
- Using fire or open flames;
- Storing or leaving any objects, particularly flammable or explosive materials;
- Carrying out maintenance, cleaning, or repair work, including refueling or draining cooling water;
- Letting the engine run unnecessarily or honking;
- Parking vehicles with defective systems (e.g., leaking fuel, oil, or other fluids) or other safety deficiencies;
- Parking in a manner that obstructs traffic (e.g., on driveways, pedestrian paths, in front of doors or gates, or within their movement areas);
- Distributing advertising material without prior written consent of the operator;
- Obstructing snow clearing or gritting operations with parked vehicles.
6.3 The operator’s staff may issue additional instructions at any time. These must be followed without exception.
7. Parking without a valid ticket and violations
7.1 Parking a vehicle without a valid and properly obtained parking ticket constitutes unauthorized possession.
7.2 In such cases, the operator is entitled to remove or tow the vehicle at the owner’s expense. Furthermore, the operator or an authorized third party reserves the right to charge a penalty fee (processing fee for documenting unauthorized possession, identifying the owner, and other administrative work related thereto).
This also applies if the vehicle is parked in violation of these parking regulations.
7.3 If payment is not made within the specified period, collection will be carried out by a service provider and/or lawyer commissioned by the operator. The owner must reimburse all resulting costs (in particular reminder, investigation, and legal fees) within 30 days.
7.4 The operator is entitled to take civil legal action (injunction, damages claim, or cease-and-desist request) in the event of violations of these parking regulations.
8. Video recordings
8.1 For parking management purposes, including automation and service acceleration for vehicles with valid parking tickets, the operator uses a video surveillance system operated in accordance with the GDPR. The processing of personal data, including license plate numbers, is carried out for a maximum of 48 hours (video recordings) for contract fulfillment and based on the operator’s legitimate interest in efficient parking management.
8.2 Personal data, including license plate numbers, collected in connection with vehicle relocation or parking without a valid ticket, will be deleted immediately once the purpose of processing (legitimate interest in documentation, identification, enforcement of claims, or defense against legal claims) has been fulfilled and no statutory retention period prevents deletion.
8.3 Further information about the operator and data protection can be found in the data protection policy.
9. Place of performance and jurisdiction
9.1 Austrian substantive law shall apply exclusively to this contract and any legal disputes arising from or in connection with it, excluding any conflict-of-law rules that would result in the application of foreign law.
9.2 For consumers residing in Austria at the time of conclusion, the statutory jurisdictions apply.
