Parking lot regulations

The following parking lot regulations apply to the use of the Hochkar Bergbahnen parking lots:

1. general provisions

1.1 The use of the parking areas (hereinafter referred to as "parking lot") is only permitted after conclusion of a contract of use.

1.2 The contract of use is concluded exclusively between Hochkar & Ötscher Tourismus GmbH (hereinafter referred to as "parking lot operator") on the one hand and the user of the parking lot in compliance with the parking lot regulations in the version valid during the parking period on the other hand.

1.3 Any use of parking areas that has not been demonstrably approved by Hochkar & Ötscher Tourismus GmbH is legally invalid and therefore inadmissible (interference with possession).

2. Subject matter of the contract

2.1 By concluding the contract of use, the user acquires the right to park a roadworthy, safe and officially approved vehicle in a free and suitable parking space between 7:00 am and 8:00 pm. Excluded from these times of use are zones specially marked by the parking lot operator, which are reserved for restaurants, overnight guests and multi-day parkers, as well as extraordinary regulations for events organized by Hochkar & Ötscher Tourismus GmbH.

2.2 This contract of use is concluded with the purchase of the parking ticket (online or at the lift ticket office on site) for the license plate number specified when purchasing the ticket. If the user uses the parking lot with a different car (different license plate number) than the one specified when purchasing the ticket online, the parking lot operator must be informed immediately at the cash desk or by e-mail.

2.3 The provisions of these parking lot regulations are agreed with the contract of use.

2.4 The provisions of the Road Traffic Regulations (StVO), as amended, apply in the parking lot. Walking speed is the maximum permissible speed in the parking lot

2.5 The guarding and safekeeping of the vehicle, its accessories, as well as any objects in the vehicle, or objects brought into the parking lot with the vehicle, is not the subject of the contract.

2.6 Designated disabled parking spaces may only be used by disabled persons with a valid, clearly visible disabled pass in accordance with § 29b StVO.

3. Liability provisions

3.1 Use of the parking lot is at your own risk. The parking lot operator is not liable for the conduct of third parties, for theft and burglary. The parking lot operator shall only be liable for damage to a motor vehicle if this was caused intentionally or through gross negligence on the part of the parking lot operator or its employees. This also applies to the re-parking of the vehicle, which is carried out by employees of the parking lot operator at the express request of the user.

3.2 Furthermore, the Car Park Operator shall not be liable for damage caused directly or indirectly by force majeure to a parked vehicle.3.3 The User undertakes to properly secure and lock the parked vehicle.

3.4 The instructions of the parking lot operator and its employees must be followed in the interest of smooth operation and safety.

3.5 Any damage to parking facilities or to other motor vehicles by the user must be reported to the parking lot operator immediately and before leaving the parking lot, as must any damage to the user's own vehicle. Such damage must be reported to the parking lot operator as soon as it becomes known and must be documented photographically and sent to the parking lot operator together with the damage report. Damage to motor vehicles that is reported after leaving the parking lot cannot be recognized. Any statutory reporting obligations remain unaffected.

4. User fees and operating hours

4.1 Vehicles may only be parked in the parking lot with a valid and legally obtained parking ticket.

4.2 The applicable tariff and any other fees can be found online in the web store and on the information boards on site.

Uninterrupted parking of the vehicle for a longer period (e.g. for several days) and parking between 8 p.m. and 7 a.m. is not permitted. Exceptions to this are specially marked zones reserved for restaurants, overnight guests and multi-day parkers as well as extraordinary regulations for events organized by Hochkar & Ötscher Tourismus GmbH.

4.4 The user fee must be paid at the latest at the beginning of the parking period.

5. Parking the vehicle

5.1 The vehicle must be parked in such a way that third parties are neither hindered nor other dedicated parking spaces, such as parking spaces for the disabled, other reserved parking spaces (such as parking spaces for electric vehicles, specially marked zones), etc., are used without authorization. The unauthorized parking of vehicles is also prohibited.

5.2 In the event that a vehicle is parked in the parking lot contrary to the provisions of these parking lot regulations - in particular if towing would be justified in accordance with the StVO - or if the permitted parking period is exceeded, the parking lot operator is entitled to take legal action against the registration holder. The costs incurred for this will be charged to the vehicle owner.

6. Rules and regulations

6.1 Only motor vehicles that are roadworthy, safe to operate and licensed for traffic may be parked in the parking lot.

6.2 The following in particular are prohibited

  • the use of fire and naked flames;

7.1 Parking a vehicle without a valid and legally obtained parking ticket constitutes a violation of ownership.

7.2 In such a case, the parking lot operator is entitled to remove the vehicle for a fee or have it towed away. Furthermore, the parking lot operator or a third party commissioned by it reserves the right to charge a penalty (processing fee for the documentation of the disturbance of possession, investigation of the registration holder and other related administrative activities), even if the parked vehicle is parked contrary to the provisions of these parking lot regulations.

7.3 If payment is not made on time, a service provider commissioned by the Parking Space Operator to process the payment and/or a lawyer will be called in, whereby the Vehicle Registration Holder must also reimburse the costs incurred for this (in particular reminder, investigation and lawyer's fees) within 30 days.

7.4 The Car Park Operator shall be entitled to take civil action (action for disturbance of possession, action for damages and/or a request to issue a declaration to cease and desist) in the event of violations of these Parking Regulations.

8. image recordings

8.1 The parking lot operator uses an image surveillance system for parking lot management, including the automation and acceleration of the service for vehicles for which a parking ticket has been booked, as the person responsible, which is operated in accordance with the provisions of the GDPR. The processing of personal data, including vehicle license plates, is carried out for a maximum period of 48 hours (video recordings) for the performance of the contract and for the legitimate interest of the controller in efficient parking space management.

8.2 Personal data, including license plate numbers, which are collected and stored by the controller in the context of the user's request to change the parking space of their vehicle or to park without a parking ticket, will be deleted immediately as soon as the purpose of the processing (legitimate interest of the controller in documentation, research and law enforcement, such as in particular civil law actions, as well as legal defense against claims for damages) is fulfilled and no statutory retention period prevents premature deletion.

8.3 Further information on the controller and data protection can be found in the data protection provisions.

9.2 For consumers who have their place of residence in Austria at the time of conclusion of the contract, the statutory places of jurisdiction shall apply.
