Terms and Conditions for Gift Vouchers
- Through the website of the operator Hochkar & Ötscher Tourismus GmbH, 3345 Göstling/Ybbs 46, info@hochkar.com (hereinafter referred to as “Operator”), individuals wishing to use the services offered by the Operator (hereinafter referred to as “Customers”) can purchase vouchers.
- The processing of voucher purchases is handled by the service provider INCERT eTourismus GmbH & Co KG. The contract is concluded between the Customer and the Operator.
- Vouchers may only be used for the purchase of services in the Operator’s webshop. The voucher value will be credited against the total invoice amount. If the selected service(s) exceed the value of the voucher, the difference can be paid using any other valid payment method. If the value of the voucher exceeds the selected service(s), the remaining balance will remain on the voucher.
- Vouchers are generally valid for 30 years, unless a shorter validity period has been agreed upon due to justified reasons.
- For the purchase of services in the Operator’s webshop, the Operator’s general terms and conditions apply, which can also be accessed on the respective website.
- The information provided during the voucher purchase process does not constitute a binding offer by the Operator but an invitation for the Customer to submit an offer based on the displayed information. A legally binding contract is only concluded once the offer is accepted.
- After selecting the desired voucher amount and entering personal data, the Customer is shown an overview of their order. The Customer has the opportunity to review and, if necessary, correct their entries.
- By clicking the “Pay” button, the Customer confirms their information and is redirected to the payment service provider. After completing the payment process, a legally binding contract is concluded.
- After payment, the voucher will be sent to the email address provided by the Customer along with the order confirmation. The vouchers can be redeemed in the Operator’s webshop during the checkout process by entering the individual voucher code.
- The Operator reserves the right to exclude certain services from being purchased with vouchers. Excluded services are clearly marked in the Operator’s webshop.
- Cash redemption of vouchers or remaining balances is excluded. Lost or stolen vouchers cannot be replaced.
- The European Commission provides a platform for online dispute resolution, available at http://ec.europa.eu/consumers/odr/. The Operator is not obliged or willing to participate in dispute resolution procedures before a consumer arbitration board.

- These general terms and conditions can be viewed, saved, and printed at any time under AGB (hochkar.com).
- The contract language is German. Only the German version of these general terms and conditions is legally binding.
- The Operator reserves the right to amend these general terms and conditions from time to time. Such amendments only apply to future voucher purchases. The version valid at the time of purchase applies. This also applies for the entire validity period of a voucher.
Information on the Right of Withdrawal
Right of Withdrawal
The Customer has the right to withdraw from this contract within fourteen days without giving any reason.
The withdrawal period is fourteen days from the day on which the Customer or a third party designated by them, who is not the carrier, takes possession of the goods.
To exercise the right of withdrawal, the Customer must inform the Operator, Hochkar & Ötscher Tourismus GmbH, 3345 Göstling/Ybbs 46, info@hochkar.com, by means of a clear statement (e.g., a letter sent by post or email) of their decision to withdraw from the contract. The Customer may use the model withdrawal form available under “Withdrawal Form,” but it is not mandatory. To meet the withdrawal deadline, it is sufficient for the Customer to send the notice before the period expires.
Consequences of Withdrawal
If the Customer withdraws from this contract, the Operator shall reimburse all payments received from the Customer, including delivery costs (except for additional costs resulting from the Customer choosing a different type of delivery than the cheapest standard delivery offered by the Operator), without undue delay and at the latest within fourteen days from the day the notice of withdrawal is received. For this refund, the Operator will use the same payment method used by the Customer for the original transaction unless expressly agreed otherwise; in no case will the Customer be charged any fees for this refund.
The Operator may withhold reimbursement until the goods have been returned or until the Customer has provided proof of return shipment, whichever occurs first.
The Customer must return or hand over the goods to the Operator without undue delay and in any event no later than fourteen days from the day on which the Customer notified the Operator of the withdrawal. The deadline is met if the goods are sent before the fourteen-day period expires.
The Customer shall bear the direct costs of returning the goods.
The Customer is only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.
