Use of Image Data

Events, Functions, and Activities

Pictures (photos/videos) are taken at various events, in particular at press conferences and other events organized by Hochkar & Ötscher Tourismus GmbH, or at events where people give presentations or performances held on our premises or on behalf of or with the support of our organization.

Invitations and events will include prior notice that photography will take place. If the media privilege (§ 9 DSG) does not apply, photographers are instructed to obtain consent for small group photos. When larger groups are photographed at events, the images serve to increase awareness and promote the image of our organization, and we may publish these photos on our website and, where applicable, in printed materials about our organization (legitimate interest).

If you are photographed as part of a small group or as an individual, the photographer will ask for your consent before taking the picture and will ask you to sign a corresponding declaration of consent as proof of your approval. If you do not agree, you will have the opportunity to step aside so as not to be included in the photograph. If the media privilege (§ 9 DSG) does not apply, you have the right to revoke your consent at any time with effect for the future.

In the event of revocation, the images will be removed where technically possible, and efforts will be made to ensure their removal from other media. Printed brochures will not be destroyed following revocation. Upon receipt of the revocation, the data will no longer be processed for the stated purpose. If costs arise as a result of revocation or prohibition of further use (e.g. website modification, destruction of printed materials), and there is no legitimate interest justifying the revocation, these costs are to be borne by the individual concerned.

You have the right to object within the scope of the applicable legal provisions if processing is based on legitimate interest. As you are participating in a public event that our organization has an interest in promoting, this expectation is also taken into account when considering objections.

The data will be deleted once the copyright protection period has expired or if consent is withdrawn, insofar as they are published on our website. If these data are published on social networks, they will only be deleted upon withdrawal of consent.

For participation in audio/image/video recordings and advertising campaigns by Niederösterreich Werbung GmbH, the following personal data of participants are processed: photo/video, first name, last name, and address. We store this personal data as long as it is required for the use of the audio/image/video recordings and advertising campaigns or for the assertion or defense of legal claims.

Information according to § 24 DSG 2000 regarding “Photocompare”

Please note that, for the purpose of access control, a reference photo of the lift ticket holder will be taken the first time they pass through a turnstile equipped with a camera. This reference photo will be compared by lift staff with the photos taken each time the holder passes through a camera-equipped turnstile. The reference photo will be deleted immediately after the lift ticket expires, and all other photos will be deleted no later than 30 minutes after each passage through the turnstile. Please note that it is also possible to purchase lift tickets that are configured so that no photo is taken when passing through the turnstile; however, random checks by lift staff must be expected in such cases.
