SunnyCard – Terms and Conditions
SunnyCard & SunnyCard PLUS
1. General Information and Scope of Services
Hinterstoder-Wurzeralm Bergbahnen AG acts as a representative of all cable car and lift companies participating in the SunnyCard and SunnyCard PLUS program, as listed at https://skisport.com/de/sunnycard.
The SunnyCard (i.e. SunnyCard PLUS and SunnyCard) can be purchased either online via the websites of participating regions or directly at participating cable car and lift companies. These Terms and Conditions apply in all cases.
The contractual partners of the customer resulting from the purchase of the SunnyCard or SunnyCard PLUS are the respective participating cable car and lift companies.
The SunnyCard and SunnyCard PLUS entitle the customer to use the facilities and slopes operated by the participating cable car and lift companies to the extent specified, as well as the local ski bus (where organized by the participating companies) during operating hours in the winter season (excluding external partner offers).
The SunnyCard PLUS additionally entitles the holder to use the participating lift facilities during the summer season (excluding bike transport and external offers).
The cable car and lift companies operate their facilities and slopes independently and under their own responsibility.
2. Conclusion of Contract
2.1 Online Order
To complete an online order, the customer must fully and accurately fill out all mandatory fields in the booking form and explicitly accept these Terms and Conditions.
False information may lead to the withdrawal of the ticket without replacement and to exclusion from transport.
SunnyCard and SunnyCard PLUS can only be booked with a current photo. The customer must immediately notify any changes to their contact details (name, address, email address).
After entering the data and clicking the “order with payment obligation” button, this constitutes a legal offer to conclude a purchase contract. Acceptance of the offer is expressly reserved.
The customer will receive an email confirming acceptance of the purchase offer within 10 days at the latest.
These provisions apply accordingly to purchases made at participating cable car and lift companies or other contractual partners. For consumers under the Austrian Consumer Protection Act (KSchG), a right of withdrawal applies to online orders (the cancellation policy and form are linked).
2.2 Scope of Services
The services included with the SunnyCard and SunnyCard PLUS may be used after receipt of the data carrier during the validity period and once the facilities have begun operation.
3. Costs / Payment
3.1 Prices
Sales are made according to the current rates published on https://skisport.com/de/sunnycard or in the displayed price lists and tariffs.
When purchasing (except in the webshop), a deposit fee (KeyCard deposit) will be charged.
Payment methods include credit card (Visa, Mastercard, Amex, Diners Club) or cash.
3.2 Replacement Cards
In the event of a lost or damaged card, a replacement can be issued for a processing fee of €25 (plus KeyCard deposit). Proof of blocking and a valid photo ID are required.
If the card was already used on the day of the loss report, the replacement card is valid only for subsequent days.
3.3 Cancellations via Online Shop
In case of withdrawal from an online ticket purchase, a cancellation fee may apply.
4. Shipping
For online orders, the SunnyCard will be dispatched within five working days after acceptance of the order. Postal delivery typically takes at least three working days.
5. Reloading a Data Carrier
The customer is responsible for entering the correct data carrier number. Incorrect entries prevent activation.
The purchased service can be used at the earliest 60 minutes after receipt of the confirmation.
6. Use of Services
These Terms and Conditions and the transport regulations of the respective companies apply.
No right of withdrawal applies in the event of:
- Bad weather
- Avalanche risk
- Operational interruptions
- Customer illness
- Overcrowded slopes
- Official restrictions (e.g. pandemics)
No refunds will be made if services are available but the customer does not use them for personal reasons (e.g. missing vaccination certificate).
7. Liability
Liability is limited to intent and gross negligence.
No guarantee is given for:
- Uninterrupted availability
- Constantly full range of services
Up-to-date information is available at ticket offices, panorama boards, and online.
8. Refunds in Case of Injury or Illness
In principle, there is no entitlement to refunds.
As a gesture of goodwill, a refund may be granted if a medical certificate is presented by March 30 at the latest.
9. Misuse
Cards are non-transferable.
Misuse results in withdrawal without replacement and an obligation to pay the cost of a day ticket plus a fine (minimum €40).
10. Data Protection
Data is processed in accordance with the GDPR and the Austrian Data Protection Act. Please refer to the privacy policies of the participating companies.
11. Governing Law and Jurisdiction
Austrian law applies.
Consumers: competent court at their place of residence or habitual residence.
EU consumers: alternatively, the court of their own residence.
Entrepreneurs: court at the registered office of the defendant company.
